IMPORTANT: PLEASE CAREFULLY READ AND UNDERSTAND THESE TERMS AND CONDITIONS (“TERMS”).
1. Your conduct
You agree that you will not use the Site or Mobile App for any purpose that is unlawful or prohibited by these Terms. Without limiting the foregoing, you agree that you will not use the Site/Mobile App:
- to spam or otherwise send unsolicited messages
- to collect information about others without their consent
- to transmit, upload or post any material that contains viruses or any other harmful programs or code
- to transmit, upload or post any material that is obscene, vulgar, offensive, defamatory, indecent, lewd, suggestive, harassing, threatening, pornographic, fraudulent, inflammatory or otherwise inappropriate or objectionable, or that breaches any laws including intellectual property including without limitation any such maternal that may infringe any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party
- to interfere with or disrupt this Site/Mobile App
- to interfere with any other person’s use or enjoyment of the Site/Mobile App
- to attempt to gain unauthorised access to any services or information
- to post, upload, transmit, distribute, store, create or otherwise publish through the Sites/Mobile Apps user content that is spam, direct marketing communications or any unsolicited advertising, promotional materials or other forms of solicitation or commercial content; or
- to post, upload, transmit, distribute, store, create or otherwise publish through the Sites/Mobile App user content that is constitutes, encourages or provides instructions for a criminal offence.

Use of the Site/ Mobile App and or registration to be a member for the Site/Mobile App (“membership”) is void where prohibited. By using the App, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 13 years of age or older; (d) your use of the Site/Mobile App does not violate any applicable law; (e) You will not use your personal profile for your own commercial gain (such as selling your status update to an advertiser); (f) you will keep your contact information accurate and up-to-date; (g) you will not upload viruses or other malicious code; (h) you will not bully, intimidate, or harass any user; (i) will not post content that: is hateful, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence; and (j) you will not do anything that could disable, overburden, or impair the proper working of the Site/Mobile App, such as a denial of service attack.
When you sign up to become a member, you will also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, email address or password of another member at any time or to disclose your password to any third party. You agree to notify Global Brands Group of Companies immediately if you suspect any unauthorized use of your account or access to your password at firstname.lastname@example.org You are solely responsible for any and all use of your account.
3. Site/Mobile App contents
Global Brands Group of Companies has made its best efforts to ensure that the information contained on or accessed through this Site/Mobile App is accurate and up-to-date. However, the materials and information on the Site/Mobile App may include technical inaccuracies and typographical errors. The materials, information and services on the Site/Mobile App are provided “as is” without any conditions, warranties and other terms of any kind. Accordingly, to the maximum extent permitted by applicable law, Global Brands Group of Companies disclaims all other warranties, express or implied, including without limitation, implied warranties of merchantability, fitness for a particular purpose, title, availability, that the Site/Mobile App is free from viruses and non-infringement as to the Sites/Mobile Apps and the information, content and materials contained therein.
You have the possibility of receiving offers through the online services. The following general terms apply to the offers: (1) the offer may only be available through that particular online service and for the product shown and subject to availability, in participating restaurants only, and until the expiration date; (2) serving times apply (e.g., certain non-breakfast offers may not be available at breakfast serving times); (3) unless otherwise stated each offer expires on redemption; (4) only one offer can be used per restaurant visit; (5) offers are not transferable; and (6) there is no cash alternative. In addition there may be specific terms that apply to the offer which are stated on the app next to the offer. Not all offers may be combined with orders.
About the products in the online services. All products are subject to availability at the restaurant where you collect your order. Some restaurants do not sell all products. Images of products and packaging on the online services are examples only and may not be identical to the product or packaging you receive from a restaurant. Differences may be due your device’s display of colors or factors such as the ingredients used, the supplier, the region of the country and the season of the year.
About the prices in ordering. Prices include local taxes and government fees as required under the law of UAE including VAT from the date of implementation of that tax in UAE. Certain offers and pricing may not be available for all orders at all locations. In the event you discover an error in the price of the product charged to you, please contact the restaurant where you purchased the product to seek a refund of the difference.
Refunds and your consumer rights. If you desire to seek a refund for any reason, including if the products are unsatisfactory or for other reasons, please contact the restaurant where you purchased the product regarding any refund due to you. Your legal rights in this respect are not affected by anything in these terms.
5. Intellectual Property
All materials and content on the Site/ Mobile App, including but not limited to text, images, photos, graphics, designs, names, logos, trademarks, video recordings, music and the selection and arrangement thereof are the property of, or used under licence by, Global Brands Group of Companies and are subject to copyright and other intellectual property protection.
- This Site/Mobile App contains commercially sensitive and valuable information which is both confidential and protected by copyright. Brands, logos, images and taglines are registered or unregistered trade marks owned or used under license by Global Brands Group of Companies
- Permission is granted to you to view content as a visitor to this Site/Mobile App. You may download and save a temporary copy of material from the Site/Mobile App for the limited purpose of viewing the Site/Mobile App for personal use or procuring products from the Site/Mobile App. Any other use of the materials and information on this Site/Mobile App, including reproduction for any purpose, modification, distribution, republication, adaptation, or commercial exploitation, without our prior written permission, is strictly prohibited.
To the fullest extent permitted by law, (and save as otherwise expressly set out in these Terms), Global Brands Group of Companies, its directors, employees, agents and representatives, exclude all liability, howsoever arising (including from negligence), for any loss or damage whether direct, indirect, special or consequential, or for personal injury which is suffered or sustained, by any user, arising in any way out of or in connection with the Site/Mobile App, including but not limited to such loss, damage or injury arising out of the following:
- the use of or inability to use this Site/Mobile App
- purchasing and/or using any product(s) from the Site/Mobile App
- any errors or omissions from any information on this Site/Mobile App including typographical or photographical errors
- any technical malfunction, error, omission, interruption, interference, communications line failure, deletion, defect, delay, virus, bug, tampering, theft or destruction or unauthorised access to the Site/Mobile App
- any injury or damage to any person’s computer related to accessing or downloading any materials from this Site/Mobile App; or
- a failure or omission on the part of Global Brands Group of Companies to comply with its obligations under these Terms
- the content or the materials contained in or accessed through the Site/Mobile App, including without limitation any damages caused by or resulting from reliance by a use of the Site/Mobile App on any information obtained from Global Brands Group of Companies or that results from mistakes, omissions, interruptions, deletion of files or emails, errors, defects, viruses, delays in operation or transmission or any failure of performance, whether or not resulting from acts of God, communication failure, theft, destruction or unauthorised access to Global Brands Group of Companies records, programmes or services
To the fullest extent permitted by law, (and save as otherwise expressly set out in these Terms) Global Brands Group of Companies:
- does not make any representation, warranty or endorsement of any kind, whether express or implied, with respect to the information or material contained on the Site/Mobile App, or the accuracy, reliability or completeness thereof; and
- expressly disclaim all representations and warranties, express or implied, with respect to the products advertised or otherwise featured on this Site/Mobile App.
Global Brands Group of Companies assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, computer viruses, bugs, unauthorised intervention, fraud, technical failures, theft or destruction, or unauthorised access to or alteration of any information provided by a website/Mobile App user.
You hereby waive, release and hold harmless Global Brands Group of Companies, its directors, employees, agents and representatives from and against any and all actions, claims, suits, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) that you may have or would have had in connection with, or arising out of, or incidental to, your access to or purchase from this Site/Mobile App and your use of any products advertised therein (save as otherwise expressly set out in these Terms).
Global Brands Group of Companies’ liability for a breach of any consumer laws is, where permitted by law and at Global Brands Group of Companies election, limited to:
- in the case of goods — the repair or replacement of the goods, or supply of equivalent goods, or payment of the cost of doing this; OR
- in the case of services — the re-supply of the services or payment of the cost of doing this.
You agree to indemnify, defend and hold harmless Global Brands Group of Companies, its directors, employees, agents, consultants, independent contractors, subsidiaries, affiliates and representatives, from and against all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) arising out of or related to (a) your use of the Site/Mobile App; (b) your violation of these Terms; (c) your violation of any rights of a third party; (d) your conduct in connection with the Site/Mobile App and (e) you purchasing and using any product(s) advertised on the Site/Mobile App.
8. Termination of Site
Global Brands Group of Companies reserves the right to modify or suspend services on this Site/Mobile App, to discontinue or terminate any or all parts of the Site, to update, edit and remove contents of the Site/Mobile App, or to terminate your ability to purchase products from the Site/Mobile App at any time without notice. In this event, the liability and indemnity provisions provided in these Terms will survive such termination, and all rights of Global Brands Group of Companies granted herein are otherwise reserved. Global Brands Group of Companies failure or delay in taking such actions does not constitute a waiver of its rights to enforce these Terms.
9. Governing law
These Terms shall be governed by and construed in accordance with of the laws of Trinidad and Tobago. You irrevocably and unconditionally agree to submit to the exclusive jurisdiction of the courts of Trinidad and Tobago.
If any provision of these Terms shall be unlawful, void or for any reasons unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
11. Online Ordering
Global Brands Group of Companies reserves the right, in its sole discretion, to reject, refuse to post or remove any posting (including, without limitation, private messages, emails and instant messages (collectively, “messages”)) by you, or to deny, restrict, suspend, or terminate your access to all or any part of the App at any time, for any or no reason, with or without prior notice or explanation, and without liability.
In addition, Global Brands Group of Companies reserves the right, in its sole discretion, to reassign or rename your profile URL. Global Brands Group of Companies expressly reserves the right to remove your profile and/or deny, restrict, suspend, or terminate your access to all or any part of the Site/Mobile App if Global Brands Group of Companies determines, in its sole discretion, that you have violated this Agreement or pose a threat to Global Brands Group of Companies, its employees, business partners, members, users and/or the public. Even after membership is terminated, this Agreement will remain in effect.
You acknowledge that Global Brands Group of Companies reserves the right to charge for any portion of the Site/Mobile App and to change its fees (if any) from time to time in its discretion. If Global Brands Group of Companies terminates your membership because you have breached the Agreement, you shall not be entitled to the refund of any unused portion of fees or payments (if any).
You agree and acknowledge that Global Brands Group of Companies may send messages including, but not limited to, notifications, special offers, promotions, commercial advertisements, and marketing materials, in connection with the Site/ Mobile App.
14. Third Party Services
Third party services created by third party developers may be available on, through or in connection with the Site/ Mobile App. Third party services include applications, web Apps, desktop, wireless, mobile and other services available from third parties which can be installed onto your Global Brands Group of Companies profile or shared with other members on the Site/Mobile App or which may link to your Global Brands Group of Companies account from outside of the Site/ Mobile App. Third party services may use your Global Brands Group of Companies profile information and content on such linked Sites/Mobile Apps and share activity events between Global Brands Group of Companies and the third party services.
15. Rewards Program
By registering to become a Rewards Member (“Member”) you hereby agree to the following terms and conditions. Additionally, use of your rewards card and/or mobile app constitutes acceptance of our Terms and Conditions.
- Only one (1) member profile/account to be allowed per person. One profile is linked to a single rewards card.
- Members cannot get points from visits prior to enrollment and membership/points are not transferable
- Points have no cash value
- Your card/Mobile app must be presented upon ordering BEFORE payment in store to receive points when making a purchase. Earning or redeeming points will not be allowed after a transaction is closed.
- Only the member paying the bill can accumulate points
- Points cannot be redeemed until your next purchase.
- Points cannot be issued after you have left the restaurant or paid your bill.
- Your accumulated points will show in your mobile app or on any one of our websites. They can also be printed in store on request at our Point of Sale
- Member Profiles with no activity for more than one year may become inactive and points will expire.
- In the rare occurrence that the program is experiencing technical difficulties or system upgrades and maintenance, points cannot be issued or redeemed until the problem has been rectified.
- Information collected from this program may be used for other marketing purposes.
- Global Brands Group of Companies reserves the right to reject membership, cancel membership and void a members’ account, points, offers and/or rewards if there are any unauthorized use by any member or member of staff.
- Points are earned based on the final total of your bill after all discounts and offers have been applied.
- Membership is a privilege granted by the Global Brands Group of Companies and may be revoked or cancelled at any time. Fraudulent use of this card would result in loss of membership and revocation of all privileges
- Global Brands Group of Companies reserves the right to change or discontinue this program at any time, in whole or part, with or without notice even though the changes may affect the value or use of any accumulated points.
- Global Brands Group of Companies may withdraw, limit, modify or cancel any award, increase the number of points required for an award or discontinue any or all benefits of the program. Accumulated points do not entitle members to any vested rights with respect to awards or benefit programs.
- If for whatever reason points are incorrectly awarded, Global Brands Group of Companies at its discretion may retroactively remove the awarded points from a members profile
- All decisions made by Global Brands Group of Companies are final and Binding
- Points are only earned and/or redeemed when an order has been successfully placed and accepted by a restaurant when using a member profile/login. To earn/redeem points for an online order you must login prior to placing your order using your correct Member Profile. Points will not be retroactively awarded.
- Points are not earned for Guest Orders. You are encouraged to sign in to your account or to create an account to earn rewards
- Membership/ Reward Offers can be used for in store and online orders unless otherwise specifically stated on the offer. Some offers may have time limits and expiry dates. Any unused offers will expire and be treated as such and not be able to be used or reactivated.
- In the rare occurrence we have having technical difficulties, offers may be unable to get applied to your bill whether in store or online
- Bonus Points and Double Points Days vary by brand/location and/or Country. Points are doubled based on the total of your bill and do not double based on your membership status.
- Your Membership Status/Tier is determined based on your Total Member points and not based on your current points. Your Total points are reset to 0 on January 1st of every year. The status you have on that day will hold for one year until the following January 1st. Your current points do not get reset each year, only your total points.
16. Gift Cards
Paying online via a gift card is subject to the terms and conditions of this Site/Mobile App. Gift Cards are only applicable and redeemable in the country for which they were purchased or issued
Gift Cards are non-refundable and cannot be redeemed for cash. If Gift Card, either physical or virtual is lost or stolen, the gift card will not be replaced. Treat the gift card as you would cash./p>
